The case collapsed when the Interior Department, which had originally told prosecutors the damage was caused by vandals, produced documents after the indictment showing the damage was the result of “flawed installation by the contractor, Atlantic Industrial Coatings,” and the rush to complete a renovation of the Reflecting Pool before America 250 Independence Day events. The pool had been painted blue at Trump’s directive ahead of the celebration. The contractor rushed the job. The lining failed. When prosecutors looked at the evidence in full, they found damage throughout the entire pool, including in the middle, where, as they noted in their dismissal filing, “a vandal would not likely have attempted to peel the lining.” Hearn had been detained by National Guard troops and US Park Police for five hours after stopping by the pool during a bike ride on June 19. He was indicted. The indictment was then withdrawn.
Pirro had promised at the press conference to prove beyond a reasonable doubt that Hearn caused the damage. Her office’s motion to dismiss said it was now “difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt.” That is the sentence that follows from the contractor admission, and it is also the sentence that describes the gap between the press conference and the withdrawal. Trump insisted the tape showed vandalism. The tape showed a man on a bike ride.
Hearn said he was “relieved” and “grateful.” He added: “I am sorry this happened to me and that it overshadowed what should be a proud moment in American history.” The contractor has not been charged. The Interior Department official who misled prosecutors has not been identified publicly. Pirro’s job is, per CNN sources, likely gone.
